ViftChat — Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your use of the ViftChat application (“Service”), operated by Vift ApS (“we”, “us”, “our”), a company registered in Denmark.
By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
2. Service Description
ViftChat is a messaging application that provides:
- Chat: End-to-end encrypted (E2EE) messaging, including text, images, videos, voice messages, and files.
- Circles: A social feed where you can share posts with your contacts.
- Stories: Temporary posts that are automatically deleted after 24 hours.
- Digital Locker: An AES-256 encrypted personal vault for storing documents and files.
- Subscription-based storage plans with varying capacities.
3. User Accounts
3.1 Registration
You must be at least 16 years old to create an account. You are responsible for providing accurate information during registration.
3.2 Account Security
You are responsible for safeguarding your login credentials. You must notify us immediately if you suspect unauthorised access to your account.
3.3 One Account Per Person
Each individual may only create one account. We reserve the right to close duplicate accounts.
4. Storage & Retention
4.1 Storage Plans

4.2 Chat Media Retention
Media in chat messages is retained for a limited period, after which it is automatically deleted from our servers:

4.3 Circles
Posts in Circles are stored permanently until deleted by the user.
4.4 Stories
Stories are automatically deleted after 24 hours.
4.5 Digital Locker
Files in the Digital Locker are stored as long as your account is active and within your storage quota.
5. Subscriptions & Payment
5.1 Subscriptions
Paid subscriptions (Premium and Platinum) are managed through the Apple App Store or Google Play Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
5.2 Payment
All payments are processed by Apple or Google through their respective payment systems. ViftChat does not receive or store your payment information directly.
5.3 Refunds
Refund policies are governed by the applicable Apple App Store and Google Play Store terms. Contact the relevant store for refund requests.
5.4 Downgrade
If you downgrade your subscription or it expires, and your storage usage exceeds the new plan’s limit, you will be unable to upload new content until your usage is within the limit. Existing files will not be automatically deleted.
6. Acceptable Use
You agree to use the Service in compliance with applicable laws and these Terms. You must not:
- Use the Service for illegal purposes.
- Send spam, unsolicited advertising, or malicious software.
- Share content that infringes the rights of others, including copyrights and privacy.
- Harass, threaten, or discriminate against other users.
- Attempt to gain unauthorised access to the Service, other user accounts, or our systems.
- Use the Service to distribute child sexual abuse material (CSAM). Such activity will be reported to the authorities.
- Circumvent technical limitations or security measures.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
6.1 Blocking & Reporting
Users can block and report other users through the app. When reporting, you may choose to include relevant messages as evidence. Since all chat messages are end-to-end encrypted, we can only review content that you voluntarily share with us as part of a report. We will review reports within a reasonable timeframe.
7. Intellectual Property
7.1 Our Rights
ViftChat, including the application, design, code, and trademarks, belongs to Vift ApS. Nothing in these Terms grants you any rights to our intellectual property beyond the right to use the Service as intended.
7.2 Your Content
You retain all rights to the content you share through the Service. By using the Service, you grant us a limited licence to store, transmit, and display your content — solely for the purpose of providing the Service to you and your chosen recipients.
8. Termination & Account Deletion
8.1 Your Termination
You may request deletion of your account at any time through the app’s settings.
8.2 Grace Period
When you request deletion, a 30-day grace period begins. During this period, you may reactivate your account. After 30 days, your account and all associated data will be permanently deleted.
8.3 Our Termination
We reserve the right to suspend or terminate your account if you violate these Terms, with or without prior notice depending on the severity of the violation.
9. Limitation of Liability
9.1 Service Availability
The Service is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation.
9.2 Limitation of Liability
To the fullest extent permitted by applicable law, Vift ApS shall not be liable for:
- Indirect, consequential, or incidental damages, or loss of data.
- Losses caused by third-party services (Apple, Google, Cloudflare, etc.).
- Losses resulting from unauthorised access to your account due to your own negligence.
9.3 Force Majeure
We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, or outages of third-party services.
10. Disputes & Governing Law
10.1 Governing Law
These Terms are governed by the laws of Denmark.
10.2 Dispute Resolution
Any disputes arising from these Terms shall first be attempted resolved through negotiation. If this is not possible, disputes shall be settled by the Danish courts, with the Copenhagen City Court (Kobenhavns Byret) as the court of first instance.
10.3 Consumer Complaints
As a consumer in the EU, you may also file complaints with the Danish Centre for Complaint Resolution (naevneneshus.dk) or the European Commission’s Online Dispute Resolution platform (ec.europa.eu/odr).
11. Changes to Terms
We may update these Terms from time to time. For material changes, we will notify you through the app at least 30 days before they take effect. Continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
